This document (as well as any other document mentioned herein) regulates the conditions governing the use of the Phexia.com website and the purchase or acquisition of products therein. For the purposes of these Terms, it is understood that the activity that Phexia E-commerce SL develops through the Web Site includes performing the following services:

Cosmetics Sales

In addition to reading these Terms and Conditions of Sale, before accessing, browsing and/or using this website, the user must have read the Legal Notice, the cookies policy, and the privacy and data protection policy.

By using this website or by making and/or requesting the purchase of a product through this website, the User agrees to be bound by these Terms and Conditions, so if you do not agree with the above, you should not use this website.

In addition, you are advised that these Terms and Conditions of Sale may change. The User is responsible for consulting them each time he/she accesses, navigates and/or uses the website, since the current terms and conditions will be applicable at the time of purchase.

2. The User

The access, navigation, and use of the website, grants the condition of user, so from the moment you start browsing the website, you accept all the conditions set forth herein, as well as its subsequent changes, subject to the application of the corresponding legal regulations where appropriate.

The User assumes responsibility for the correct use of the website. This responsibility extends to:

  • Using this website only to make inquiries and legally valid purchases or acquisitions.
  • Not to make any false or fraudulent purchases.
  • Provide truthful and lawful contact information, i.e., e-mail address, mailing address and/or other information.

The User declares to be over 18 years of age and to have legal capacity to enter contracts through this website. The website is primarily intended for users residing in Spain and Europe. Phexia does not ensure that the website complies with the laws of other countries, either wholly or partially.

  1. Scope of General Terms and conditions

These General Conditions apply to the sale of all Phexia products through its website in Europe. Phexia informs that its website is intended exclusively for users over 18 years of age. Phexia reserves the right to cancel the access account of a customer if fraudulent, improper, or malicious acts are detected in the use of this service.

4. Objective

These conditions of online purchase apply to the purchase of any product on Phexia.com made by customers whose delivery address is in Europe.

The prices of each product are indicated on the website on the date the order is placed. The prices are detailed in each item including taxes and fees. The amount of shipping costs and any other service is also specified and will be shown to the customer in detail at the time the order is placed.

The purchase service through Phexia.com regulated in these Terms and Conditions of Sale only allows the purchase of products to customers over 18 years of age and with delivery address in Europe.

Phexia reserves the right to cancel the access account of a customer if fraudulent, improper, or malicious acts are detected in the use of this service.

If necessary, Phexia will modify and update articles and prices according to the company's commercial criteria, although the changes will not affect the products that have been accepted.

All orders for products are subject to availability and, if there are stock shortages or if there are no items in stock, we reserve the right to provide information about substitute products of equal or superior quality and value which the customer may order. If you do not wish to order such substitute products, we will refund any amount you may have paid.

Phexia offers users a cosmetics sales service.

5. Purchase Limit

For security reasons, purchases of more than 1000 euros or more than 100 items per order cannot be made. Those customers who are interested in making purchases for a higher amount should contact Customer Service via email at wecare@phexia.com, where they will be provided with information on how to make the desired purchase.

6. Access and Purchase Terms and Conditions

This information and the content in Phexia.com do not constitute an offer to sell, but an invitation to do business. No contract shall exist between the customer and Phexia.com in relation to any product until the order has been expressly accepted (even if your account has already been debited). If the offer is not accepted and the customer's account has already been debited, the amount will be refunded to the customer in full.

To place an order, the customer must follow the online purchase procedure and click on "Finalize Order". After this, the customer will receive an e-mail acknowledging receipt of the order (Order Confirmation). Please note that this does not mean that your order has been accepted, as the order is merely an offer to Phexia to purchase one or more products. All orders are subject to acceptance by Phexia, which will confirm such acceptance by sending an email informing that the product is being shipped (Shipping Confirmation). The contract for the purchase of a product between Phexia and the customer (Contract) will be formalized only when the Shipping Confirmation with its corresponding invoice is sent to the customer.

Only those products listed in the Shipping Confirmation shall be subject to the Contract. Phexia shall not be required to supply any other products that may have been ordered by the customer until the shipment of the same has been confirmed in a separate Shipping Confirmation email.

There may even be exceptional circumstances (in accordance with Law 10/2010, of April 28, 2010, on the prevention of money laundering and terrorist financing) that make it necessary to refuse to process an order after the Order Confirmation has been sent. Phexia reserves the right to do so at any time, at its sole discretion.

The purchase of services in Phexia.com can only be made by users over eighteen (18) years of age, who must follow the steps and instructions of the entire purchase process, consisting of, but not limited to:

(i) Completion of the registration form or identification form for previously registered users.

(ii) On-screen display of the order summary, delivery details and - if applicable - shipping costs.

(iii) Acceptance of the terms and conditions of purchase, which implies the reading, understanding and irrevocable acceptance of each of these General Conditions, as well as, if applicable, of the existing Special Conditions.

7. Prices

The prices of the products shown on the website are those applicable at the time of purchase. Prices may be subject to change without notice but will not affect orders that have already been accepted.

All product prices include VAT. Shipping costs are added per order once the location and delivery method have been specified.

Prices may be modified by Phexia at its own discretion, either due to the upward variation of the CPI of the previous year or due to the change in raw materials. The prices may also be subject to changes due to the application of promotions or specific campaigns.

8. Payment

Payment can be made by credit or debit card, Klarna deferred payment or Klarna Pay Now online bank transfer. In any case, the choice of payment method is made during the checkout process on the corresponding screen.

Phexia.com uses secure payment systems from top suppliers, to offer maximum security. The customer must notify Phexia of any unauthorized or fraudulent charge on the card used for purchases, by email, in the shortest possible time so that Phexia can take the appropriate steps. The suppliers or issuers of payment methods may adopt anti-fraud measures that involve the rejection of certain types of transactions. Phexia is not responsible for the application of this type of security policies.

You expressly authorize us to issue the invoice in electronic format, although you may at any time tell us that you wish to receive a paper invoice, in which case, we will issue and send the invoice in this format. Phexia will issue an invoice, in the name of the individual or company placing the order, and it will be attached to the purchase confirmation email, once the order has left our warehouses. Phexia advises that it cannot subsequently modify the sales invoices in compliance with current regulations.

9. Cancellation and Returns

The reason for the return is due to a defect, or receipt of a wrong product.

Cancellation made at the customer's request.

Due to the special nature of Phexia.com products, the following must be considered:

  • No returns or cancellations will be accepted for products that are not suitable for return for reasons of health  or hygiene, except for those that are defective
  • Products to be returned must be properly packaged, in perfect condition and unused.

Terms, refund, costs, and procedure:

Terms (Cancellation): the customer has 14 calendar days from receipt of the product(s) to cancel the contract without obligation.

Terms (Returns):  Phexia shall be liable for any non-conformity within the period established in the legal regulations.

Refund (Cancellation/Return): Phexia will refund, if applicable, the corresponding amount, excluding the standard shipping costs of the initial delivery without undue delay and, in any case, before 14 calendar days have elapsed from the date on which it has been informed of the return. The refund will be made by the same method of payment that was used. However, Phexia may withhold it until we have received the products, or the customer has provided proof of the return, whichever condition is met first.

Fees ( Cancellation): The customer will be responsible for all product(s) return costs.

Costs (Return): Phexia will be responsible for all product(s) return costs, the customer may also choose to exchange the product for another in perfect condition or for the correct item, or to be reimbursed for the product(s).

In case of cancellation the return costs are paid by the customer, but Phexia offers the buyer a simple return system to facilitate the process in the case of orders from the Peninsula, Balearic and Canary Islands. It is a landing page where the customer can fill in their information for pick up. The cost is the same as the shipping cost and will be deducted from the amount to be refunded.


In the case of an international order, the customer must contact Customer Service to make a cancellation or return, either by email at wecare@phexia.com. In all cases, the cancellation form below must be completed.

Refunds are subject to Phexia's right to withhold amounts for returned products that are damaged.

10. Customer Service

Phexia has a customer service department so that the user can process their complaints, questions, or cancellations.

The user may address complaints, claims or requests for information to Phexia's Customer Service Department by sending an e-mail to wecare@phexia.com or filling in the form available in the "Contact" section.

All questions and especially complaints and suggestions will be answered as quickly as possible, without exceeding in any case the deadlines established by the legislation in force.

11. Warranties

The warranty offered is the one established in the Royal Legislative Decree 1/2007, of November 16, 2007, which approves the revised text of the General Law for the Defense of Consumers and Users.

12. Delivery

Delivery time will be:

  • Peninsula - 24 hours if you place the order before 5 pm, otherwise it will be in 48 hours- SameDay delivery available in Barcelona  (if the order is placed before 3 pm).
  • Balearic Islands - 24 hours for Balearic if the order is received before 5 pm, otherwise it will be 48 hours.
  • Canary Islands - 48-72 hours.
  • Rest of Europe 3-4 days.

Orders will be delivered to the address provided by the customer according to the following criteria:

Home Delivery: If the order is equal or higher than €79, the shipping is free for Peninsula including Portugal. For Europe, Canary Islands, and Balearic Islands shipping is free for orders over €99.

The address provided by the customer may be a home address, a place of business or any other address provided. It is not necessary that the billing address and shipping address match. Our delivery provider will send an e-mail with the delivery date. You may also change the delivery point or choose a post office / GLS convenience point through these communications.

Delivery Attempts: Couriers make two delivery attempts. If unsuccessful, it will be delivered to a post office / GLS convenience point and the customer will be given the address to pick it up. If after 10-14 days the customer has not shown up to claim his order, it will then be returned to our warehouse.

Phexia does not ship to Ceuta, Melilla, or Andorra.

13. Product Availability

In the event of any supply issues or if there are no products left in stock, the customer will be informed immediately and will then be refunded the amount of the out-of-stock product(s). Phexia will refund the corresponding amount without undue delay and, in any case, before 14 calendar days have elapsed. The refund shall be made in accordance with the provisions of Clause 9.

14. Contract Language

These general terms and conditions of sale are written in Spanish. In the event that they are translated into one or more foreign languages, the Spanish text shall prevail in case of dispute.

15. Applicable law

These General Conditions are governed by Spanish law and the parties agree to be subject to it for the resolution of conflicts and renouncing any other jurisdiction or to the courts and tribunals of the domicile of the user.
